Welcome to Toni’s Feathered Cluckers DNA Lab. These Terms of Service (“Terms”) govern your use of our website and the purchase and use of DNA testing services provided by Toni’s Feathered Cluckers DNA Lab.
By accessing our website, purchasing a DNA test, submitting a DNA sample, or otherwise using our services, you agree to these Terms. Please read them carefully before submitting samples for testing.
DNA Testing Services
Toni’s Feathered Cluckers DNA Lab provides avian DNA testing services, which may include DNA gender/sex testing and genetic testing for specific traits or genes offered on our website.
Available tests, eligible species, pricing, sample requirements, and testing options may change as our services expand or laboratory procedures are updated.
DNA testing is performed using the biological sample submitted to our laboratory. Results correspond to the sample and identification information provided by the customer.
Customer Responsibility for Sample Collection
Customers are responsible for collecting and submitting samples according to the sample collection instructions provided by Toni’s Feathered Cluckers DNA Lab.
Depending on the test and species, accepted sample types may include feathers, blood, eggshell/membrane material, or other sample types specifically approved by our laboratory.
Customers are responsible for ensuring that:
- Samples are collected from the correct bird.
- Samples are collected according to our instructions.
- Each bird’s sample is kept separate from samples belonging to other birds.
- Samples are properly packaged and labeled.
- The identification information submitted with each sample is accurate.
- Samples are protected from contamination during collection, handling, and packaging.
Failure to follow sample collection instructions may result in an inconclusive result, contamination, insufficient DNA, or the need for a replacement sample.
Sample Identification and Labeling
Each sample must be clearly identified using the bird ID, band number, name, color, number, or other identifier provided by the customer.
Toni’s Feathered Cluckers DNA Lab relies on the identification information supplied by the customer and cannot independently verify which individual bird a submitted sample originated from.
Customers are responsible for ensuring that samples are not accidentally switched, mixed, mislabeled, or contaminated during collection and packaging.
Results will be reported according to the identification provided with the submitted sample.
Toni’s Feathered Cluckers DNA Lab is not responsible for incorrect results or identification issues caused by customer sample mix-ups, incorrect labeling, collection from the wrong bird, or cross-contamination between birds.
Sample Quality, Contamination, and Inconclusive Results
DNA testing requires a sufficient amount of usable biological material.
Samples that are improperly collected, contaminated, damaged, degraded, insufficient, collected on unsuitable material, or otherwise unable to provide enough usable DNA may produce an inconclusive result.
An inconclusive result does not necessarily indicate an error in laboratory testing.
Because laboratory supplies, testing materials, reagents, and processing time may already have been used, an inconclusive result does not automatically qualify for a refund.
At our discretion, Toni’s Feathered Cluckers DNA Lab may allow the customer to submit a properly collected replacement sample for retesting.
Additional testing or mailing costs may apply when the original sample was unusable due to sample collection, contamination, insufficient material, improper packaging, or another issue outside the laboratory’s control.
DNA Gender/Sex Testing
DNA gender/sex testing determines the genetic sex indicated by the DNA present in the submitted sample.
Results apply only to the biological material that was submitted and cannot independently confirm the physical identity of the bird from which the customer collected the sample.
Customers should therefore take care when collecting samples from multiple birds to prevent cross-contamination or accidental sample switching.
Genetic Trait Testing
Toni’s Feathered Cluckers DNA Lab may offer testing for specific genetic traits or genes, including tests such as the Blue Egg Gene and Recessive White Gene.
Genetic testing reports the genetic markers detected through the particular test ordered. A genetic test result does not guarantee the appearance, quality, health, breeding performance, fertility, hatchability, or future offspring of any bird.
Genetic expression and breeding outcomes may be affected by additional genes, inheritance patterns, environmental factors, and other biological variables that are not evaluated by a particular DNA test.
Customers are responsible for making their own breeding and flock-management decisions based on their individual circumstances.
Accuracy and Limitations of DNA Testing
Toni’s Feathered Cluckers DNA Lab takes reasonable care to provide reliable DNA testing using appropriate laboratory procedures.
However, no laboratory test should be interpreted as an absolute guarantee.
Testing may be affected by factors including, but not limited to:
- Sample quality
- Sample contamination
- Insufficient DNA
- Degraded biological material
- Incorrect sample identification
- Samples collected from the wrong bird
- Mixed biological material from multiple birds
- Improper collection or storage
- Biological or genetic variation
- Limitations associated with the particular test performed
If we determine that an error occurred as part of our laboratory testing process, we will provide a retest at no additional testing charge. If a retest cannot reasonably be completed, we may issue a refund for the affected test.
Turnaround Times
Any turnaround time stated on our website, social media, order information, correspondence, or other materials is an estimate unless specifically stated otherwise.
Turnaround time generally begins when a usable sample and all necessary identifying information have been received by Toni’s Feathered Cluckers DNA Lab, not when the customer places the order or mails the sample.
Testing may occasionally take longer because of sample quality, retesting, laboratory workload, holidays, equipment issues, supply availability, shipping delays, or circumstances outside our reasonable control.
We do not guarantee that results will be available by a particular breeding, sale, show, hatch, or other deadline.
Mailing and Shipping Samples
Customers are responsible for mailing samples to the address provided by Toni’s Feathered Cluckers DNA Lab and for ensuring adequate postage and proper packaging.
We strongly recommend using a mailing method that provides tracking.
Toni’s Feathered Cluckers DNA Lab is not responsible for samples that are lost, delayed, damaged, misdirected, returned, or otherwise affected while in the possession of USPS or another mail or delivery carrier.
Our responsibility for a sample begins after it has been successfully delivered to and received by us.
Postage and shipping charges are nonrefundable.
Retesting and Laboratory Errors
If Toni’s Feathered Cluckers DNA Lab determines that an error occurred during our laboratory testing process, we will provide a retest at no additional testing charge when possible.
A new sample may be required to complete the retest.
If we determine that a retest cannot reasonably be completed, we may issue a refund for the affected test.
Retesting due to customer sample collection problems, contamination, incorrect labeling, mixed samples, insufficient biological material, or other circumstances outside our laboratory process may be subject to additional charges.
Orders, Payments, Cancellations, and Refunds
Payment is required according to the prices and payment methods available through our website.
Because DNA testing involves customized laboratory services performed specifically for each submitted sample, orders generally cannot be canceled or refunded once sample processing or laboratory testing has begun.
Orders may be eligible for cancellation before samples are mailed to or received by our laboratory, subject to our current Refund Policy.
Refunds, cancellations, inconclusive samples, retesting, and laboratory errors are governed by our Refund Policy. If there is a conflict between this section and our posted Refund Policy regarding a refund or cancellation, the posted Refund Policy will control.
Digital Test Results
DNA testing results are delivered electronically using the email address or contact information associated with the customer’s order or sample submission.
Customers are responsible for providing a valid and accurate email address.
Once laboratory testing has been completed and results have been delivered, the completed testing service and digital report cannot be returned.
Customers should review their results when received and contact us promptly if they believe there is an error involving the information displayed on their report.
Use of DNA Results
DNA test results are provided for informational, breeding, flock-management, identification, and other lawful purposes.
Customers are responsible for deciding how to use their results.
Toni’s Feathered Cluckers DNA Lab is not responsible for breeding decisions, purchases, sales, rehoming decisions, financial decisions, loss of anticipated offspring, reduced breeding value, or other decisions made based on DNA test results.
Customers who sell or transfer birds based on testing results are responsible for accurately representing those results to third parties.
Results should not be altered or presented in a misleading manner.
Limitation of Liability
To the fullest extent permitted by applicable law, Toni’s Feathered Cluckers DNA Lab will not be liable for indirect, incidental, consequential, special, or economic losses arising from the use of our services or reliance on DNA testing results.
This may include, without limitation, loss associated with breeding decisions, bird purchases or sales, lost breeding opportunities, expected offspring, hatch results, loss of profits, or other consequential losses.
Where liability cannot legally be excluded, our liability related to a particular DNA testing service will, to the fullest extent permitted by law, be limited to the amount paid for the affected testing service.
Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded under applicable law.
Website Information
We make reasonable efforts to keep the information on our website accurate and current.
However, information concerning testing availability, species, pricing, turnaround times, sample requirements, and other services may occasionally be changed or updated.
We reserve the right to correct errors, update information, modify services, or discontinue a testing option when necessary.
Intellectual Property
Unless otherwise stated, the text, graphics, branding, laboratory instructions, sample collection materials, educational content, photographs, designs, reports, and other original content provided by Toni’s Feathered Cluckers DNA Lab are owned by or licensed to Toni’s Feathered Cluckers DNA Lab.
Our content may not be copied, reproduced, republished, sold, or used commercially without permission, except where permitted by law.
Customers may retain and share their own DNA testing reports for legitimate personal, breeding, sales, or recordkeeping purposes.
Prohibited Use
You may not use our website, testing services, reports, business name, or materials for unlawful, fraudulent, deceptive, abusive, or misleading purposes.
We reserve the right to refuse or discontinue service when we reasonably believe our services are being misused, provided that any refund required by applicable law or our policies will still be honored.
Privacy
Information submitted through our website and DNA testing services may include customer contact information, order information, sample identification information, and testing information.
We use this information as reasonably necessary to process orders, perform testing, communicate with customers, maintain laboratory records, provide customer service, and operate our business.

Changes to These Terms
We reserve the right to update or modify these Terms of Service as our services, laboratory procedures, website, or legal requirements change.
The version posted on our website at the time a service is purchased will generally govern that transaction, except where a change is required by law.
Continued use of our website or services after updated Terms are posted constitutes acceptance of the updated Terms for future transactions.
Governing Law
These Terms and your use of our services are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable federal law or another mandatory law provides otherwise.
Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
